Terms of Use

1. Acceptance

By accessing and using https://chimtitan.ro ("the Site") you confirm that you have read, understood and accepted these terms. If you do not agree, do not use the Site.

2. Who we are

The Site is owned and operated by Chimtitan S.R.L., a Romanian legal entity registered at B-dul Basarabia, Nr. 248A, Bucuresti, Sector 3, 030352, Romania.

3. Nature of the Site and how orders work

The Site is an informational commercial catalog that presents Chimtitan's product range and services (industrial, professional-decorative and retail paints) and offers a contact form. The Site does not support placing orders online, payment processing, user account creation or the conclusion of a distance contract. Any information published (prices, availability, specifications) is indicative and does not constitute an offer within the meaning of Art. 1188-1189 of the Romanian Civil Code.

Orders are discussed, agreed and confirmed exclusively outside the Site — through our sales representatives, by email at vanzari@chimtitan.ro, by phone at 021.255.01.09, or by written commercial contract between Chimtitan S.R.L. and the client.

Accordingly, the provisions of Romanian Government Emergency Ordinance 34/2014 on consumer rights in distance contracts (including the 14-day right of withdrawal) and Regulation (EU) No 524/2013 on the ODR platform do not apply to use of the Site, since no contract is concluded through it.

4. Technical product information

Published specifications (coverage, drying time, resistance, corrosivity classes, etc.) are indicative and reflect standard laboratory conditions. Before applying any coating system, consult the official Technical Data Sheet (TDS) and Safety Data Sheet (SDS), or request technical advice at vanzari@chimtitan.ro.

5. Intellectual property

All trademarks, logos, text, images, videos, formulations, recipes and source code are the property of Chimtitan S.R.L. or our partners and are protected under Romanian and international copyright and related-rights law. Reproduction, distribution or commercial use without Chimtitan S.R.L.'s written consent is prohibited.

6. Permitted use

You agree not to use the Site in a way that:

• violates Romanian, European or international law;
• infringes the rights of others or of Chimtitan S.R.L.;
• interferes with Site operation (attacks, mass scraping, code injection, etc.);
• extracts data for commercial use or AI training without written permission.

7. Limitation of liability

The Site is provided "as is". Chimtitan S.R.L. makes reasonable efforts to keep information accurate and current but makes no warranty as to accuracy, completeness or fitness for a particular purpose. To the extent permitted by law, we are not liable for indirect damages arising from use of the Site.

8. Links to third-party sites

The Site may contain links to pages operated by third parties (e.g. Google, Microsoft). Chimtitan S.R.L. does not control their content and is not responsible for their practices.

9. Personal data

Personal data processing is described in our Privacy Policy.

10. Changes

We may update these terms as needed. The current version is always displayed on this page with the revision date. Continued use of the Site after publication constitutes acceptance.

11. Governing law and jurisdiction

These terms are governed by Romanian law, in particular the Civil Code, Law 365/2002 on electronic commerce and Law 8/1996 on copyright. Any dispute that cannot be resolved amicably is subject to the courts having material and territorial jurisdiction at the registered office of Chimtitan S.R.L. (Bucuresti, Sector 3).

12. Severability and waiver

If a provision of these terms is held invalid or unenforceable by a competent court, the remaining provisions remain in force. Failure by Chimtitan S.R.L. to exercise a right does not constitute a waiver of that right.
